The Personal Finance Report USA respects copyright. If material on personalfinancereportusa.com infringes yours, this page explains how to have it removed under the Digital Millennium Copyright Act.
Where to send a notice
Send takedown notices to [email protected] with DMCA Notice in the subject line. Notices sent by any other route may be missed.
What a valid notice must contain
The DMCA requires specific elements. A notice missing them cannot be acted on, so please include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorised to act for them.
- Identification of the copyrighted work you say has been infringed. If several works are covered by one notice, a representative list.
- Identification of the material you say is infringing, with enough detail for us to locate it. A direct URL is the most useful thing you can give us.
- Your contact details: name, address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
What we do when we receive one
We aim to acknowledge a complete notice within three business days. Where a claim is properly made out, we remove or disable access to the material promptly and notify whoever posted it, passing on a copy of your notice. We keep a record of notices received.
We do not require a court order before acting, and we do not charge to process a notice.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address with DMCA Counter-Notice in the subject line. It must include your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief the removal was a mistake, your contact details, and your consent to the jurisdiction of the appropriate federal court.
We will forward a valid counter-notice to the original complainant. If they do not file a court action within the statutory period, the material may be restored.
Repeat infringers and false claims
We terminate the posting privileges of repeat infringers. Please also be aware that the DMCA imposes liability for knowingly making a material misrepresentation in a notice or counter-notice. If you are unsure whether the use you are complaining about is infringing, or is fair use, take advice before filing.
If we have used your work
We source and attribute deliberately, as set out in our Editorial Process. If we have got an attribution wrong rather than infringed outright, a note to the same address will usually resolve it faster than a formal notice, and our Corrections Policy covers how we record the fix.
